You may be wondering, do I have to go to Bankruptcy Court? Probably not.  I mean, there is a mandatory meeting everyone who files bankruptcy must attend, about a month after filing, called theSection 341 Meeting of Creditors.  That is a very misleading name, as rarely, if ever, do creditors appear at the meeting.  And, the meeting is not held in a Courtroom.  It’s a bout a 5 minute meeting with the Trustee appointed to your case, you, and me.

As an Orlando bankruptcy attorney, it is very rare for my clients to have to appear at any hearing other than the Meeting of Creditors.  Because this meeting is not held in theBankruptcy Court, then you could say that No, you will probably not have to go to court when you file for bankruptcy.

In a Chapter 7 Bankruptcy, most unsecured debt is eliminated without you having to pay anything back to your creditors.  In a typical Chapter 7 case, you will only need to make one appearance at the Meeting of Creditors and will never even see the Bankruptcy Judge.  I know, as an Orlando bankruptcy attorney, that most of my clients would rather not attend bankruptcy Court if they can help it, and I do my best to make sure that the Meeting of Creditors is the extent of their required attendance.
