The “new” Bankruptcy law, passed in 2005, imposes certain income eligibility requirements for people wanting to file Chapter 7 bankruptcy.  Eligibility is determined by a test that takes into consideration a person’s income — relative to that of his or her state’s median income — for a household of comparable size. Here’s a link to a median income table to give you an idea what I’m talking about. These tables change about every 6 months, so keep that in mind.
The thing is, the income requirement is only a starting point in determining whether Chapter 7 is right for you. For example, you may be eligible to file a Chapter 7 bankruptcy based on your income, but you may also have assets that you do not want to lose if you file Bankruptcy.
