Chapter 13 Bankruptcy: It’s All About Having a Plan

When my clients hire me to become their Orlando bankruptcy lawyer, they do so in large part because I have constructed a detailed Chapter 13 payment plan for them at their first meeting with me, which of course is FREE.  In that Chapter 13 plan, which is filed with the Court at the beginning of a case, I spell out for my clients exactly what their monthly payment will be to the Chapter 13 Trustee and my clients immediately see how much debt they are eliminating.

One of the strongest myths that has survived since the bankruptcy laws changed in 2005 is that, in a Chapter 13 bankruptcy, you have to pay back ALL of your credit card debt.  This has never been the case and, as an Orlando bankruptcy lawyer, I routinely file what are called “0% plans” for my clients. Meaning, you pay NOTHING back to your credit cards during the Chapter 13 payment plan.

You Can Keep Your Property

In Chapter 13 Bankruptcy, some of your debt is consolidated into a repayment plan while other debt is completely eliminate and you don’t have to pay it back.  This payment plan may pay back a percentage of your unsecured debt (think Credit cards, medical bills, etc…) over a three to five year period by you making monthly payments to a Chapter 13 Trustee.

In addition to structuring a payment plan that works for you, we work hard on your behalf to ensure you can keep the property you want to keep and eliminate your liability to pay for property you may not want to keep.

What About Student Loan Debt?

Student loan debt generally cannot be discharged through Bankruptcy.  However, there is relief to be had through the filing of a Chapter 13 Bankruptcy. I can help buy you some time, up to 5 years, to avoid having to pay crippling student loan debt.  The idea here is that when you finish the bankruptcy 5 years from now you will be debt free, hopefully have some money saved up, and the you can tackle the student loan debt.
