Creditors Must Follow The Law
Under the Fair Debt Collection Practices Act, most creditors seeking personal debt repayment cannot use certain collection tactics, including:
- Calling you in the middle of the night
- Calling your workplace, if you informed them that collections calls violate your employer’s policy
- Contacting other people to find out more information about you other than basic contact information
- Contacting other people about you multiple times
- Discussing your debt with someone else besides your spouse, parent or attorney
- Continuing to call you directly after you have notified them that you have legal representation
- Verbally abusing you or threatening your safety

Why Bankruptcy Forces Creditors To Stop Calling
When my clients file bankruptcy, all of their creditors get contacted and put on notice of the filing. The bankruptcy law imposes what is called an “automatic stay” against those creditors contacting my clients regarding the collection of a debt.
In many ways, this automatic stay is the best friend of bankruptcy attorneys and their clients. It can give you time and space to focus on getting a fresh start out of your bankruptcy case. The automatic stay can even pause foreclosure proceedings.
Nearly all creditors will abide by the automatic stay and leave you alone after you file bankruptcy. For any creditors who ignore their legal obligations and continue harassing you, they may face stiff penalties. The bankruptcy judge can hold creditors accountable for violating the automatic stay, and I will pursue those penalties as appropriate.
